Shangqiu People’s Procuratorate accused three defendants on Maserati of endangering public safety by dangerous means, and plaintiffs Qiao Moumou and Wang Moumou filed incidental civil actions at the same time. The public prosecutor accused: At 19 o’clock on July 3, 2019, the defendants Tan Moumou, Liu Moumou and Zhang Moumou went to a kebab shop in yongcheng city for dinner and drinking. After the dinner, at 22: 22, Xu Zhang Moumou contacted the driver by phone. Before the driver arrived, Tan Moumou drove the NE5S55 Maserati levante SUV and pulled Liu Moumou and Zhang Moumou to leave, driving along several sections of Yongcheng City. After rubbing eight roadside cars in succession, Tan Moumou was forced to stop because he could not pass, and was discouraged by the surrounding people and the car owners who crashed. Liu Moumou and Zhang Moumou asked Tan Moumou to leave quickly. Tan Moumou ignored the dissuasion of the masses and rushed out to escape. When he reached the intersection of East Outer Ring Road and Yongxing Road, he chased the Yu N0182L BMW sedan waiting for the traffic signal at high speed, causing the BMW sedan to catch fire, causing the occupants Ge Moumou and Jia Moumou to die on the spot, and the driver Wang Moumou was seriously injured. Tan Moumou, Liu Moumou and Zhang Moumou were arrested by the public security organs on the spot. On August 13, 2019, the procuratorate approved the arrest of three people.
The public prosecution agency believes that the defendant Tan Moumou continued to drive in a collision despite dissuasion after a traffic accident caused by drunk driving, causing heavy casualties and economic losses. The defendants Liu Moumou and Zhang Moumou knew that Tan Moumou was drunk and had an accident and still instigated him to escape, resulting in more serious consequences. The actions of the three defendants all constituted crimes of endangering public safety by dangerous means. In the joint crime, Tan Moumou is the principal offender, and Liu Moumou and Zhang Moumou are the accomplices.
During the trial, the public prosecution agency read out the indictment and produced relevant evidence, the defendant and his defender conducted cross-examination, and both the prosecution and the defense fully expressed their opinions. The plaintiff and his agent ad litem in the civil litigation attended the proceedings and expressed their opinions, and the defendant made a final statement.
